Andrew Zacharda manages the full spectrum of title insurance litigation, primarily as assigned defense counsel. Among the claims that Drew successfully handles are boundary line disputes, indexing errors, mortgage priority disputes, gaps in chain of title, equitable subrogation, affordable housing restrictions or unrecorded mortgages and other instruments. In addition to claims work, Drew represents title insurance carriers directly in coverage disputes and recovery actions on paid claims.
Drew also represents mortgage lenders and servicers in all aspects of mortgage litigation in New Jersey, Pennsylvania and New York. He came to Tompkins McGuire in 2005 with over ten years' experience representing mortgage lenders and servicers in a wide variety of litigated matters, and has continued that practice with the firm. As part of that practice, Drew defends his clients in FDCPA, RESPA, FCRA, TILA, foreclosure rescue and state law consumer fraud cases. He also represents mortgage lenders and servicers in contested foreclosure litigation.
In addition, Drew handles a variety of matters in Bankruptcy Court, including adversary proceedings for non-dischargeability and defense of trustee litigation. He also contributes to the firm's professional liability defense efforts, particularly in matters involving real estate.
