Defense Verdict Reached After Virtual Trial

Tompkins McGuire Managing Partner Joseph K. Cobuzio and associate Kimberly D. McDougal secured a complete defense victory after a Superior Court trial before Hudson County Judge Kimberly Espinales-Maloney.  The two-and-a-half week trial – which was conducted entirely virtually – involved the defense of a tractor trailer driver (and his company) after his truck hit the plaintiff’s parked vehicle.  The plaintiff claimed hundreds of thousands of dollars in medical expenses, and demanded the defense’s insurance policy limits.  The defense conceded that the driver caused the accident, but Mr. Cobuzio successfully argued that the minor accident was unrelated to the plaintiff’s multiple lumbar fusion surgeries.  The jury returned a “no cause” verdict, resulting in the plaintiff collecting no damages whatsoever from either the tractor trailer driver or his employer.
